Meet your eSigning Compliance Needs with Nitro Sign Premium
Nitro Sign Premium has been verified as a fully compliant eSignature solution by DLA Piper. This means our solution meets the highest standards under the following regulations:
- Electronic Identification, Authentication and Trust Services (eIDAS)
- Electronic Signatures in Global and National Commerce Act (ESIGN) and Uniform Electronic Transactions Act (UETA)
- Federal Act on Electronic Signatures (FAES)
- Electronic Transactions Ordinance (ETO)
- Electronic Transactions Act (ETA)
- Electronic Transactions Act (Cth) and the Corporations Act (Cth)
Let’s take a look at each regulation in further detail.
eIDAS - European Union
The Electronic Identification, Authentication and Trust Services (eIDAS) regulation defines the legal structure for electronic identification, signatures, seals and documents throughout the European Union. Three signing methods are classified under this regulation: simple electronic signatures, advanced electronic signatures & qualified electronic signatures. Nitro Sign Premium is a compliant solution under the eIDAS legislation.
UETA & ESIGN - United States
Under the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA), eSignatures are legally binding and enforceable. ESIGN was enacted at the federal level, meaning it directly applies to every U.S. state. UETA is at state level therefore each state can choose to enact UETA in full, in part or in a modified form as a state law. Nitro Sign Premium fully complies with these regulations.
FAES - Switzerland
The Federal Act on Electronic Signatures (FAES) regulates the conditions under which service providers may use certification services with electronic signatures. Like eIDAS, there are three types of eSignatures: simple, advanced and qualified. Qualified electronic signatures are fully court-admissible, while simple and advanced signatures require more evidence to be fully validated. Nitro Sign Premium’s electronic signatures are the equivalent to a handwritten signature under this law.
ETO - Hong Kong
The Electronic Transactions Ordinance (ETO) provides the legal framework for the recognition of electronic records, contracts and signatures in Hong Kong. The ETO identifies two forms of signatures: electronic and digital. Both are granted the same legal status as their paper counterparts. This means Nitro Sign Premium is a legally recognized eSignature solution in this region.
ETA - Singapore
The Electronic Transactions Act (ETA) regulates the security and use of electronic transactions in Singapore. It recognizes two forms of electronic signatures: simple and secure. Secure electronic signatures, also known as digital signatures, must meet specified security procedures. Nitro Sign Premium meets the requirements for simple electronic signatures under the ETA.
ETA - Australia
Under the Electronic Transactions Act (ETA), electronic signatures are recognized as a valid means of executing documents at a federal level in Australia. In the States and Territories, legislation that mirrors the ETA exists with some exceptions. Nitro Sign Premium meets the requirements for the full execution of eSignatures as defined in this regulation.
